Trade Marks Registry (IP India) — sample certificate of registration
Illustrative sample. Your official certificate is issued after approval.
Trademark renewal is the statutory process of extending a registered trademark’s validity for another 10 years under Section 25 of the Trade Marks Act, 1999. The owner files Form TM-R on the IP India e-filing portal and pays the prescribed government fee to maintain legal protection. Without renewal, the Registrar removes the mark from the Register, ending enforcement rights.
A registered trademark in India remains valid for 10 years from the date of application (not from the date of registration). Once that period ends, you must renew to continue using the ® symbol, sue for infringement and block similar marks. There is no upper limit on how many times you can renew. Brands that renew on time keep perpetual ownership of their mark.
Filed up to 6 months before expiry under Rule 57. Standard government fee only. No surcharge. Recommended for uninterrupted protection.
Filed within 6 months after expiry. Standard fee plus surcharge. The trademark remains legally valid during this window under Section 25(2).
Filed within 1 year of removal under Section 25(4). Requires renewal fee plus restoration fee. Subject to Registrar’s approval.
Restoration is no longer possible. A fresh Form TM-A application is required — longer timeline, full fees and risk of intervening third-party filings.
Maintains exclusive rights under Section 28. Without renewal, the mark is removed and all enforceable rights end.
Unlike patents, trademarks can be renewed indefinitely every 10 years. Your brand identity remains an asset forever.
Only a registered (and current) owner can file an infringement suit under Section 29 and claim damages and injunctions.
Using ® on an expired mark is a criminal offence under Section 107. Renewal keeps the symbol lawful on packaging and marketing.
An active registration blocks identical or similar marks under Section 11. Once removed, competitors can apply for your mark.
Licensing revenue, brand valuation and IP-backed financing all depend on a current registration. Renewal preserves that value.
Confirm the trademark registration number, class(es), current proprietor details and exact expiry date from the IP India portal or certificate.
File before expiry for standard fee; within 6 months after for surcharge; after removal (within 1 year) for restoration with additional fee.
Registration certificate (or copy), identity/entity proof of proprietor, Form TM-48 if filing through an agent, and any address/name change forms if needed.
Submit Form TM-R on the IP India e-filing portal with the correct class(es) and pay the government fee (and surcharge/restoration fee if applicable).
Monitor the application on the portal. Processing typically takes 30–60 days. Respond to any Registry query if raised.
Once accepted, the renewed registration certificate is issued reflecting the new 10-year validity. Registration number remains the same. Set a reminder for the next cycle.
Original or digital copy with registration number, class details and proprietor name as currently on the register.
PAN, Aadhaar or Passport for individuals; Certificate of Incorporation / LLP Agreement for entities.
Renewal application form completed with registration number, proprietor details and class(es) sought to be renewed.
Form TM-48 authorising the trademark agent or attorney to file and prosecute the renewal on your behalf.
If name or address has changed since last renewal/registration, file the appropriate amendment form (e.g. TM-P) along with supporting proof.
In some cases the Registry may seek confirmation of continued use. Keep sales/usage evidence ready if asked.
